Ethics and Modality calls for a reevaluation of standard views of modality. I argue that, instead of understanding de re modal talk as tracking the modal properties of things in themselves, we must recognize the importance of prior conceptual priorities and interests in shaping our de re modal judgments. A consequence of this reevaluation is that de re modal claims are indeterminate in that there can be disagreement over a claim without either side having made any factual, definitional or logical (...) mistake. According to the standard view, necessities of identity are among the most secure of de re modalities. I show how determinations of whether Hesperus is Phosphorus, or Dr. Jekyll is Mr. Hyde can be disputed without either side falling into error. Disagreements are often ended by identifying a mistake underlying one or other of the opposing views, but indeterminacy undermines the chances for such principled resolution of disagreements concerning de re modal judgments. ;This reevaluation has important practical ramifications. I argue that the notion of loss, which has great ethical and legal significance, relies on a de re modal analysis. De re modal indeterminacy threatens our ability to defend those commonplace ethical and legal judgments that rely on the modally grounded notion of loss. It is possible for disputants to agree on all relevant facts, on the concepts being deployed, on logical principles and even on matters of ethical theory, and yet still, because of modal indeterminacy, find nothing to resolve their disagreement over an alleged loss. This is troubling when we allege that an act has resulted in a loss in order to justify moral condemnation, demands for compensation and the imposition of punishment. I outline some possible responses to these difficulties. Some options preserve a notion of loss, however I do not find these conservative responses promising. I argue that abandoning commonsense ideas about compensation and doing without the notion of loss can preserve what really matters in our everyday ethical and legal thinking. (shrink)

Abstract This essay takes up the fundamental question of the proper place of history in the study of political thought through critical engagement with Mark Bevir's seminal work, The Logic of the History of Ideas . While I accept the claim of Bevir, as well as of other exponents of the so-called “Cambridge School,“ that there is a conceptual difference between historical and non-historical modes of reading past works of political philosophy, I resist the suggestion that this conceptual differentiation (...) itself justifies the specialization, among practicing intellectuals, between historians of ideas and others who read political-philosophical texts non-historically. Over and against the figure of the historian of ideas, who interprets political thought only in the manner of a historian, I defend the ideal of the pupil, who in studying past traditions of political thought also seeks to extend and modify them in light of contemporary problems and concerns. Against Bevir, I argue that the mixture of historical and non-historical modes of learning, in the manner of the pupil, need not do damage to the historian of ideas' commitment to scholarship that is non-anachronistic, objective, and non-indeterminate. Susan Sontag once remarked that since the invention of the camera, photography has “kept company with death.” And indeed, images of suffering human beings and devastated landscapes appear regularly in the popular media and even in contemporary art. This volume explores these painful images from the past few decades of photography, weighing in on the intense critical debate that has arisen in recent years around depictions of acute human suffering—especially those that are beautifully rendered. Drawing on works from advertising, photojournalism, (...) art photography, and conceptual art, Beautiful Suffering features reproductions of all the pieces in the Williams College Museum of Art exhibition that shares its name—including portrayals of AIDS sufferers, Abu Ghraib prisoners, refugees, and casualties of war. It also includes five critical essays that engage the works themselves as well as the larger issues the exhibition confronts: Is it inherently problematic to seek aesthetic pleasure in a rendering of pain? And if so, why? These essays, composed by scholars in fields as diverse as art history and political science, are perfect complements to the powerful images of suffering that probe some of the most pressing issues we face today. This study explored Christians’ view that living a healthy lifestyle by eating right and exercising was essential to what being a Christian meant to them, theoretically representing internalization of these health behaviors into one’s religious values and identity. Using a secondary data analysis of Pew Research Center survey data, we found that a minority of Christians (16%) internalized a healthy lifestyle; who also tended to be more religious, as expressed by believing in God, reading scripture, praying, and volunteering at church. (...) The results provide preliminary support for the theorized disconnect in religious internalization of certain health behaviors, but not others. However, further exploratory analysis suggests that individuals who are a part of denominations that more recognizably express the importance of a healthy lifestyle as a part of their religious beliefs, and internalize this belief, might subsequently participate in and self-report healthier behavior. For centuries it has been assumed that democracy must refer to the empowerment of the People's voice. In this pioneering book, Jeffrey Edward Green makes the case for considering the People as an ocular entity rather than a vocal one. Green argues that it is both possible and desirable to understand democracy in terms of what the People gets to see instead of the traditional focus on what it gets to say. While it is customary to understand the citizen as a decision-maker, in fact most citizens rarely engage in decision-making and do not even have clear views on most political issues. Grounded on this everyday phenomenon of spectatorship, The Eyes of the People constructs a democratic theory applicable to the way democracy is actually experienced by most people most of the time. In approaching democracy from the perspective of the People's eyes, Green rediscovers and rehabilitates a forgotten "plebiscitarian" alternative within the history of democratic thought. Building off the contributions of a wide range of thinkers--including Aristotle, Shakespeare, Benjamin Constant, Max Weber, Joseph Schumpeter, and many others--Green outlines a novel democratic paradigm centered on empowering the People's gaze through forcing politicians to appear in public under conditions they do not fully control. One of the foundational texts of interpersonal psychoanalysis, _Prelogical Experience_ is a pioneering attempt to elaborate an interpersonal theory of personality that encompasses the nonpropositional, nonverbal dimension of human experience. Prelogical processes, the authors hold, cannot be consigned to infancy; rather they shape experience throughout life and are especially salient in relation to dreams, emotion, perception, and the arts. Of special note is Tauber and Green's elaboration of the clinical situation that grows out of an appreciation of prelogical experience. In (...) a striking anticipation of contemporary thinking, they approach patient-therapist interaction in terms of the continuous exchange of "presentational data" by patient and analyst. These data enable patient and therapist alike to "know" more about the other than can ever be expressed in propositional terms. This perspective assigns an important role to what Piaget would term "the cognitive unconscious" in the clinical process. It likewise sustains a view of the countertransference - which includes the analyst's own dreams - as a vital source of presentational data about the patient. In this sequel to his prize-winning book, The Eyes of the People, Jeffrey Edward Green draws on philosophy, history, social science, and literature to ask what democracy can mean in a world where it is understood that socioeconomic status to some degree will always determine opportunities for civic engagement and career advancement. Under this shadow of unfairness, Green argues that the most advantaged class are rightly subjected to compulsory public burdens, but he also attends to the uncomfortable aspects of (...) ordinary, “second-class” citizenship as well: above all, the “reasonable envy,” “principled vulgarity,” and need for “extrapolitical solace” that will inform everyday citizens’ efforts to seek democratic ends within a political landscape permanently darkened by plutocracy. Deeply engaged in the history of political thought, the book is still first and foremost an effort to illuminate present-day politics. With the plebeians of ancient Rome as his muse, Green develops a plebeian conception of contemporary liberal democracy, at once disenchanted yet idealistic in its insistence that the Few-Many distinction might be enlisted for progressive purpose. Green’s analysis is likely to unsettle all sides of the political spectrum, but its purpose looks beyond narrow partisan concerns and aims instead to understand what the ongoing quest for free and equal citizenship might require once it is accepted that our political and educational systems will always be tainted by economic inequality. This article provides new information on the printing and readership history of the fifth edition of De iure belli ac pacis. Building on our earlier research on the way that the dispute between Willem Janszoon Blaeu and Johannes Janssonius influenced the publication of the 1631 edition of the text, this article studies how Blaeu harnessed his position to make the 1632 edition more reputable than the earlier version published by his rival. The article considers how, over four centuries, readers have (...) appreciated the quality of the production and three engaged with the text for radically different ends: Remigius Faesch, Baron von Boineburg, and Wendell Phillips. The article draws attention to the changes and continuities in reading and annotation patterns and offers preliminary insights into the themes that these influential readers focused on. This special issue presents developments in research on the cognitive mechanisms and consequences of surprise. Amidst much progress, surprise research has often been siloed, so, as editors, we have sought to juxtapose insights, theories, and findings, to support cross‐fertilization in future research. The present paper sets the stage by presenting a historical summary, highlighting contrasts in definitions, and tracing major threads running through this issue and the larger surprise literature.

The collapse of confidence in anonymization as a robust approach for preserving the privacy of personal data has incited an outpouring of new approaches that aim to fill the resulting trifecta of technical, organizational, and regulatory privacy gaps left in its wake. In the latter category, and in large part due to the growth of Big Data–driven biomedical research, falls a growing chorus of calls for criminal and penal offences to sanction wrongful re-identification of “anonymized” data. This chorus cuts across (...) the fault lines of polarized privacy law scholarship that at times seems to advocate privacy protection at the expense of Big Data research or vice versa. Focusing on Big Data in the context of biomedicine, this article surveys the approaches that criminal or penal law might take toward wrongful re-identification of health data. It contextualizes the strategies within their respective legal regimes as well as in relation to emerging privacy debates focusing on personal data use and data linkage and assesses the relative merit of criminalization. We conclude that this approach suffers from several flaws and that alternative social and legal strategies to deter wrongful re-identification may be preferable. (shrink)

The evaluation of new theories and pedagogical approaches to business ethics is an essential task for ethicists. This is true not only for empirical and applied evaluation but also for metatheoretical evaluation. However, while there is increasing interest in the practical utility and empirical testing of ethical theories, there has been little systematic evaluation of how new theories relate to existing ones or what novel conceptual characteristics they might contribute. This paper aims to address this lack by discussing the role (...) of metatheorising in assessing new approaches to ethics. The approach is illustrated through evaluating a new pedagogy and curriculum for ethics education called Giving Voice to Values (GVV). Our method involves identifying a number of metatheoretical lenses from existing reviews of ethical theories and applying these to examine GVV’s conceptual elements. Although GVV has been explicitly presented as a pedagogy and teaching curriculum, we argue that it has the potential to contribute significantly to the development of ethical theory. We discuss the general implications of this metatheoretical method of evaluation for new approaches to business ethics and for GVV and its future development. (shrink)

Mark Balaguer’s project in this book is extremely ambitious; he sets out to defend both platonism and fictionalism about mathematical entities. Moreover, Balaguer argues that at the end of the day, platonism and fictionalism are on an equal footing. Not content to leave the matter there, however, he advances the anti-metaphysical conclusion that there is no fact of the matter about the existence of mathematical objects.1 Despite the ambitious nature of this project, for the most part Balaguer does not (...) shortchange the reader on rigor; all the main theses advanced are argued for at length and with remarkable clarity and cogency. The first edition of Hugo Grotius’s De iure belli ac pacis was published in Paris by Nicolas Buon in 1625. An unauthorised second edition appeared in Frankfurt a year later, from the reputable Wechel press. After Grotius made hundreds of changes to the first and second states of the first edition, and failed to convince the publisher Nicolas Buon of the merits of printing yet another edition of the book, the Wechels’s release of a new edition sought to capitalise on (...) the high demand for the text, as copies had sold out in Central Europe by the summer of 1625. In this preliminary report on the 1626 edition, using online and card catalogues, we have located 59 surviving copies. We examined thirteen copies in person, and another three fully digitised copies online, and on the basis of this small sample we have been able to draw a number of conclusions. We hope that this research note on preliminary results will generate interest in this unduly neglected edition, and that readers will kindly bring further copies to our attention. (shrink)

The idea of self-reliance is important not only because it is often taken to be definitive of the ethics of democratic individualism, but because its greatest theorists have been uncommonly forthright about a problem that, though familiar to ordinary civic experience, frequently gets ignored: that self-reliant individuality is a basis for not fully supporting otherwise endorsed social justice causes. This article turns to Ralph Waldo Emerson, Henry David Thoreau and Bob Dylan who are unusual for so honestly reflecting upon this (...) problem and who, because of the differences in the way they conceptualize it, are instructive for civic ethics. I demonstrate that Emerson and Thoreau imbue their self-reliant withdrawal from social action with a self-satisfaction that is lacking for Dylan, who is much readier to acknowledge the moral costs of self-reliance. This acknowledgement does not invalidate self-reliance but alters its epistemological, ethical and political features, providing a variant of self-reliance more suitable to contemporary conditions. In studies of early Christian thought, 'philosophy' is often a synonym for 'Platonism', or at most for 'Platonism and Stoicism'. Nevertheless, it was Aristotle who, from the sixth century AD to the Italian Renaissance, was the dominant Greek voice in Christian, Muslim and Jewish philosophy. Religions of the Constantinian Empire provides a synoptic review of Constantine's relation to all the cultic and theological traditions of the Empire during the period from his seizure of power in the west in 306 ᴄᴇ to the end of his reign as autocrat of both east and west in 337 ᴄᴇ. Divided into three parts, the first considers the efforts of Christians to construct their own philosophy, and their own patterns of the philosophic life, in opposition to Platonism. The (...) second assembles evidence of survival, variation or decay in religious practices which were never compulsory under Roman law. The "religious plurality" of the second section includes those cults which are represented as demonic burlesques of the sacraments by Firmicus Maternus. The third reviews the changes, both within the church and in the public sphere, which were undeniably prompted by the accession of a Christian monarch. In this section on "Christian polyphony", Mark Edwards expertly moves on from this deliberate petrifaction of Judaism to the profound shift in relations between the church and the civic cult that followed the Emperor's choice of a new divine protector. Abstract: This paper argues that continua of both genetic and environmental manipulation give rise to cases in which it is indeterminate whether the non-identity problem arises. In clear non-identity cases, impersonal principles can underwrite intuitions of wrongdoing. In clear cases of ordinary personal harm, ordinary ethical thinking about personal compensation augments or supersedes impersonal considerations. Indeterminate cases raise a special problem because it is indeterminate whether personal ethical considerations apply. Might indeterminacy of identity preclude a determinate and ethically justified resolution (...) of personal compensation claims? Hugo Grotius’s best-known work, De iure belli ac pacis, appeared in 1625 in Paris with the author’s approval. A second unauthorised version was published in 1626 in Frankfurt. In 1631 the Amsterdam publisher, Willem Janszoon Blaeu (1571–1638), issued the third edition, this one authorised by the author – and this edition featured nearly a thousand revisions by Grotius. The purpose of this report is to analyse the context behind the publication of this third edition and the copies’ provenance records. While Sceptics canvassed arguments against the existence of any gods, and Cynics were abrasive in their strictures on conventional religion, late antiquity offers no indubitable evidence of naked disbelief in the divine. Christians were called atheists because they abstained from popular and mandatory acts of worship, Epicureans because they denied the providential ordering of the world. In Christian literature the term is applied both to pagans, on account of their failure to recognise the true God, and to heretics who denied (...) God any part in the creation or governance of the material realm. The ‘fool’ of Psalm 53.1 was characterized by some commentators as an absolute atheist by others only as a practical atheist. For all humans, sexual orientation and gender identity are essential elements of identity, informing how we plan and live our lives. The historic invisibility of sexual minorities in medicine has meant that these important aspects of their identities as patients have been ignored, with the result that these patients have been denied respect, culturally competent services, and proper treatment. Likely due to historic rejection and mistreatment, there is evidence of reluctance on the part of LGBT patients to disclose their sexual (...) orientation (SO) or gender identity (GI) to their health care providers. There is some perception of risk in sharing SO and GI for many patients who have had bad prior experiences. Despite these risks, we argue that we can improve the quality of care provided this population only by encouraging them to self‐identify and then using that information to improve quality of care.One strategy both to prompt patient self‐identification and to store and use SO and GI data to improve care centers on the use of electronic health records. However, gathering SO and GI data in the EHR requires a workforce that knows both how to obtain and how to use that information. To develop these competencies, educational programs for health professionals must prepare students and educators to elicit and to use sexual orientation and gender identity information to improve care while simultaneously ensuring the safety of patients, trainees, and staff and faculty members as SO and GI become openly discussed and integral parts of ongoing medical discussion and care. As determination of SO and GI demographics becomes more common in health research, we will more fully understand the health risks for all the LGBTIQQ populations. (shrink)

Gregor Samsa awakes to find himself transformed into a gigantic bug. The creature’s inchoate flailing leads Gregor’s sister to conclude that Gregor is no more, having been replaced by a brute beast lacking any vestige of human understanding. Sadly, real cases of brain injury and disease can lead to psychological metamorphoses so profound that we cannot easily think that the survivor is the person we knew. I argue that there can be cases in which statements like, “It’s just not Gregor (...) anymore,” are not merely figures of speech. With this in mind, I consider three possible results of saving a biological life: (1) ordinary cases where saving the life will save the person, with strong duties to save the life; (2) cases where the intervention needed to save the life will replace the person, with strong duties not to save the life; (3) cases in which it is indeterminate whether the person will be saved or replaced. How should we think about indeterminate cases? Impersonal ethical considerations miss the point, while standard person-affecting considerations are inapplicable. I suggest turning attention away from survival towards a richer focus on what I call “personal concern.” I show how considerations of personal concern, unlike those of self-interest, need not be tied to survival and how this allows personal concern to provide a basis for ethically substantive discussion of cases where saving a life might result in losing the patient.
